How is your role in government different from an elected official? Hello, I am The Honorable Ramona Salvarez and I am a Federal circuit judge appointed by a Democratic president. I have been a judge for 19 years. I think the only way I differ from any other elected official is that I was appointed by a Democratic president when others are usually appointed by a governor. Another way I am different is judges serve the people.
I overlook the cases and make sure that the facts are real. How is it the same? I think it’s the same because we were all appointed by respected individuals. Another way is we all have the same interest in government, which is being a judge. Another way we are the same is we all serve the people and we all want equality. Do you think judges should be elected? Explain why or why not. I think they should be elected because if they are elected, then it’s for a reason. Also, it’s by people who have been in this part of government for a while so I would think that they know what they’re doing.
However, I do think there could be conflict of interest when electing judges. What is judicial review? Judicial review is when judges have the power to deny laws and acts if they think it’s unconstitutional. I think judicial review relates to checks and balances because judicial review is to make sure the law isn’t unconstitutional and checks and balances basically makes sure that one group or organization doesn’t have too much power (branches of government) Please explain the role of judicial review in a case you recently decided.
A case I recently decided was about a music company. The consumers say that they were charged almost directly after their free trial ended. This was against the consumer rights in certain states. Some people who had this free trial came to the courts about this issue but the information they brought with them was from a different state. The website did state it when the consumers signed up for the free trial but it wasn’t clear which means it wasn’t fair to the consumer or the company. This didn’t apply to a law or act so it was denied and that’s how this case applied to judicial review. Please explain how you arrived at your decision, including different factors that affected it.
There are many factors I kept in mind during this case. One of those factors being that it’s not just one’s fault. It’s both the consumers and the companies fault. The consumers are at fault because they didn’t read the guidelines thoroughly like they should but it’s the companies fault because they didn’t state it clear enough. I decided that the consumers should get their money back.
