The theory is due to Immanuel Kant (1724- 1804), deontological ethics also called Kantian ethics. “The actions must be guided by universal principles that apply irrespective of the consequences of the actions. In addition an action can only be morally right if it is carried out as a duty, not in expectation of a reward.
” (Source from Collin Fisher and Alan Lovell, 2003, Business Ethics and Values, page 77, pressed by Pearson Education Limited). The value of a persons actions lies in his/her motives rather than the outcome. It is a categorical imperative requirement to act morally.Healthy and Safety Executive is a department which assist the railway industry to ensure that risks to passengers, railway workers and the public from the running of the railway are properly controlled. (R8) After this accident happened, the HSE had a train safety report. It showed that the British rail companies were failing to improve safety on cost grounds. The HES had reported of 1996-97 on railway safety, the safety knowledge is very limited as the railway managers thought they had nothing more to do. Moreover, some rail employers are even misusing the industry’s system of risk assessment as a justification for reducing safety levels.
Therefore “they take offence if a Railway Inspector asks for something to be modified to reduce danger. The reality is that no safety system can cover all physical features and human aspects of a particular organisation- there will always be room for improvement. “As these report shows, the government and the HSE had already been aware of the railway safety problems, the staff’s safety knowledge and the profession training. Management For the management, coping with change in safety and security that company should practice basic principles. The firm could provide the railway disclosure of risk information on proposed or current construction and resources utilization projects The disclosure of risk information on facility operations: The company is responsible to tell that of those likely to be involved either directly in production or dealing with problems is given full information on hazards.
And company also should give information on the workplace that full information on The health and safety hazards of production or service should be given in advance to the staffs. Full information and notification are essential:The appraisal of risk and the successful management of hazards require a clear understanding of their nature. Employee Employees also have responsibilities to the company just as the company has responsibilities to its employees. Employees should qualify themselves to a higher certification if they are working in a hazard environment such as train drivers. Workers should be required to be better qualified and needed to pass a competency test.
If workers think their working environment is not safe enough or their mangers reject their duties, workers should have a responsibility to exposure this. Analysis and Conclusions:Health and safety is very important to business management and the HSE is also in a very important position to control the safety of the rail industry. It is understandable that some accident which can not be avoided, they should be minimised. Lessons should be learnt from any accidents and actions taken to prevent further incidents.
The HSE however have produced an annual report of any accidents and provided an analysis with advice to the rail industry to reduce the risks. By applying the Theological and Deontological theories into the Train crash and especially in the Watford Train crash in 1990’s.It has showed that the rail industry should harmonize these two theories to maximize the profit but also create a good and safe management system for the company. In my conclusion, I would like to say that, after reading the Watford train crash and others train accidents, I was very sad and angry with the drivers and all the system of NLR. Because of their lack of safety lives were lost. It has made me very worried about my safety when travelling by train.
The Health and Safety Executive need to force train companies to increase safety as soon as possible in order to prevent future disasters..
